insurance??illegally parked

hey my gf has recently had an accident involving a parked car >.< the parked car was on a junction at the bottom of a steep hill.... this is against the highway code >.< as it was slippery she hit black ice and slid into the illegally parked car is she still liable or should she fight it??
 
Not familiar with UK legislations, but let me say what would hapend here:

Police would clame her guilty and the court should hire (don't know the english word for that profession - something like CSI for traffic) some expert to analise what hapens.
If she can prove her speed was not above limit, and she was not able to see car parked until last moment, and to prove there was ice just before the parked car - with skillful lawyer the blame should be taken by company which maintain that road and person who parked car.
Of course, in UK could be different, but maybe you get some ideas how to fight.
 
Generally it's the driver behind that is usually at fault.
But this instance is a tough choice.
I'd suggest phoning her insurance company and explain to them.
They will tell you over the phone whether or not to fight it out.
 
If the parked car was on double yellows/single yellow's WITH NO DRIVER in the car, then there is a chance that you other persons insurance should pay.

Other than that, I think its bad news I'm afraid. :(
